The Indian Supreme Court, led by Chief Justice Dhananjaya Yeshwant Chandrachud, recently made a significant ruling on the status of the Indian Illegally Occupied Jammu and Kashmir (IIOJK). In a decision kept confidential until September 5, the court declared that the region, affected by the removal of Articles 370 and 35A from the Indian Constitution, is now an integral and inseparable part of India.
This move, orchestrated by the Narendra Modi-led government, altered the special rights granted to IIOJK, leading to its division into two parts under central government control on August 5, 2019.
Despite joining the Indian Union, the court emphasized that the region hadn’t attained internal sovereignty. Furthermore, the Supreme Court instructed the election commission to conduct elections in IIOJK by September 2024, providing the residents an opportunity to participate in the electoral process and choose their representatives.
